The crash took place around 1 p.m. Saturday on I-90 in the Town of East Greenbush near Albany, according to New York State Police.
The initial investigation found that August Rice, 23, of Rexford, was traveling eastbound on I-90 when he struck a vehicle causing it to cross the median and into the westbound lanes where it was struck by a vehicle driven by Rex Tucker-Moss, 41, of Poughquag in Dutchess County, state police said.
The driver of the vehicle that was struck in both the eastbound and westbound lanes was killed.
Police determined at the scene that both Rice and Tucker-Moss were intoxicated and that Tucker-Moss was driving drunk with two children, ages 10 and 7 in the car, they said.
Rice was arrested for vehicular manslaughter, DWI while impaired by drugs and moving from the lane unsafely. He was remanded to the Rensselaer County Jail in lieu of $10,000 cash or bail bond.
Tucker-Moss was arrested for vehicular manslaughter, two counts of aggravated DWI under Leandra's Law for having children in the vehicle, DWI, and two counts of endangering the welfare of a child.
He was remanded to the Rensselaer County Jail in lieu of $5,000 cash or bail bond.
The victim’s name is not being released pending notification of family members.
